German Ethics Council Says Government Should Decriminalize Incest

“Criminal law is not the appropriate means to preserve a social taboo,” stated the German Ethics Council in it’s 90-page analysis supporting the decriminalization of incest in Germany.  The 26 member German advisory council on ethics, which was created to advise the German government, voted earlier this week (by a two-to-one margin) to move towards the decriminalization of incest between consenting adults in Germany in response to a case in which a brother and sister in Saxony had four children together.

Here is a brief overview of the case:

  • The brother and sister couple were raised separately
  • When they first met, the brother was an adult and the sister was 16
  • The brother was sentenced to more than three years in prison for incest by a German court
  • The brother appealed the decision in the European Court of Human Rights but guilty verdict was not overturned
  • Two of the couple’s four children are disabled
  • The court ruled that the brother and sister couple should be forced to live apart in order to protect their children from the consequences of their relationship

According to NBC News, the council concluded that “the right of adult siblings to sexual self-determination in a consensual relationship weighs heavier in these cases than the abstract good of the family.” It added that “neither the consequences for the family nor the possibility for descendants from such incestuous relationships can justify a ban under criminal law.”

It is unlikely that the law will change. Germany’s Christian Democrats rejected the recommendation and spokesperson Elisabeth Winkelmeier-Becker said, “The abolition of the offense of incest between siblings would be the wrong signal.”
