Gorsuch, Sotomayer Join Forces To Push Back On Fake News Report

Supreme Court Justice Sonia Sotomayor and colleague Justice Neil Gorsuch released a joint statement on Wednesday denying any tensions regarding masks, with Sotomayor asserting that she did not request that Gorsuch wear a mask in light of the rising number of COVID-19 cases.

The conservative group on the Supreme Court’s bench has been represented by Gorsuch, who has been the only justice to appear without a mask on the bench for arguments this month, according to court watchers.

Sotomayor, 67, who suffers from type 1 diabetes, which puts her at an increased risk from COVID-19, has chosen to engage in oral arguments from a distance beginning early this month.

“We were taken aback when we heard that Justice Sotomayor had requested that Justice Gorsuch wear a mask. It is not true “In a joint statement released by the court on Wednesday, Sotomayor and Gorsuch expressed their views.

“While we may differ on the law from time to time, we are warm colleagues and friends,” they said, without specifying whose reports they were referring to.

According to Nina Totenberg of NPR, Sotomayor felt uncomfortable being near people who were not wearing masks, and she chose to listen to arguments from her chambers rather than the courtroom.

According to the site, Chief Justice John Roberts had requested that colleagues use masks, however Gorsuch apparently rejected.

In a second statement published on Wednesday, Roberts categorically denied the allegations made in the paper.

According to CNN, citing a person familiar with the matter, Sotomayor voiced her concerns to Roberts, but did not specifically request that Gorsuch wear a mask.

In addition to participating in oral arguments from her chambers, Sotomayor has participated in justices-only conference sessions via video conference, according to a CNN story quoting a court spokesperson. Sotomayor was appointed to the Supreme Court in January.

A court official noted at the time that Supreme Court Justice Stephen Breyer, 83, had participated in oral arguments via video conference earlier this month “out of an excess of caution” after having tested positive for a drug that turned out to be bogus.

All of the justices of the United States Supreme Court have been immunized against COVID-19 and have had booster vaccinations as well.
