Trump's Legal Team Fights Back: Emergency Appeal Filed in Georgia To Remove Fani Willis

In response to a decision that permits Fulton County District Attorney Fani Willis to continue working on the former president's election fraud case, Donald Trump's attorneys filed an emergency appeal in Georgia on Monday.

Last Monday, Judge Scott McAfee made the decision that Willis or special prosecutor Nathan Wade—whom she was romantically involved with—had to stand away from the case. Wade immediately took this action. According to USA Today, Trump and his seven co-defendants have requested the disqualification of every member of the district attorney's office in their first January petition.

According to the Hill, the defendants have submitted a nine-page application to McAfee requesting approval of a certificate of urgent review, which would allow them to appeal to a higher state court before to the trial [which has not yet started]. The attorneys would have ten days to request an appeal by the appellate court if the judge grants their request. Such appeals are not often granted, according to Melissa Redmon, head of the University of Georgia's Prosecutorial Justice Program. According to the petition, McAfee permitted Willis to continue working on the case despite what seems to be a conflict of interest among the prosecutors and the possibility that an outsider might question the objectivity of her decision-making. Trump's attorney Steven Sadow released a statement saying, "The Court's Order is ripe for pretrial appellate review for these reasons among others."
