America First Legal Exposes Department of Justice Violation: Hunter Biden's Unregistered Foreign Agent Work

America First Legal claims in a new lawsuit that the Department of Justice broke the law when it permitted Hunter Biden to work as a foreign agent without registering as one.

According to the lawsuit, Hunter Biden was required by law to register as a foreign agent when he worked for "Ukrainian and Chinese principals" during the Obama administration. Even though the FBI took possession of Hunter Biden's laptop, which contained evidence of his international business dealings, in November 2019, the lawsuit claims that the Justice Department never "required Mr. Biden" to register as a foreign agent.

Hunter Biden was a board member for Burisma Holdings Limited, a Ukrainian gas company that paid him $1 million annually, and American First Legal claims that during this time, Biden worked as a foreign agent. According to America First Legal, emails obtained from the NARA "confirm" that Hunter Biden "directly represented Burisma in its dealings with the Obama White House."

The lawsuit, which requests that Hunter Biden register as a foreign agent, is the most recent in a string of claims that Hunter Biden received preferential treatment from the Department of Justice. Republicans have long argued that Hunter Biden broke the Foreign Agent Registration Act while working for Burisma and CEFC China Energy, a Chinese energy conglomerate. However, Biden only faced two minor tax-related charges and a gun charge that is expected to be cleared from his record.

According to America First Legal Vice President and General Counsel Gene Hamilton, "the Attorney General has a non-discretionary duty to make sure that Hunter Biden registers as a foreign agent under FARA and provides the American people with transparency into his activities on behalf of foreign principals."

According to the emails made public by the National Archives and Records Administration, in May 2014, Hunter Biden spoke with a senior member of his father's staff about his work at Burisma. On matters relating to corporate governance, transparency, and expansion, Hunter Biden stated in a letter that he is "of counsel."

Just over two years later, Hunter Biden received an email from a different senior staff member in the Office of the Vice President informing him that his father and he had just finished a phone call with Petro Poroshenko, the president of Ukraine. The details of that conversation are unknown.

Gal Luft, a former business associate of Joe Biden, was charged earlier this month by the Department of Justice for, among other things, failing to register as a foreign agent for his work with CEFC China Energy. After his arrest earlier this year, Luft claimed that the Justice Department was punishing him as retaliation for providing information about the Bidens to the department in 2019.

Hamilton stated that "any other American would have faced criminal charges for engaging in this conduct and failing to register as a foreign agent—but not under Merrick Garland's Department of Justice, which continues to go above and beyond to support President Biden, his family, and his radical liberal allies."
