The Biden administration is being sued by Republican Texas Attorney General Ken Paxton in an effort to stop the $1.6 trillion spending bill that he claims was passed illegally.
Paxton said in an exclusive interview with Fox News Digital, "If we're going to start just ignoring provisions of the Constitution, then we don't have a constitution." For the first time in our history, they disregarded the quorum under Nancy Pelosi.
This week, Paxton requested an injunction to stop the Biden administration from enforcing the budget act. According to Paxton, doing so would stop millions of government dollars from funding illegal immigrants in Texas.
In accordance with a regulation established in 2020 that permits lawmakers to "designate another Member as a proxy," Nancy Pelosi, D-Calif., then-Speaker of the House, permitted 226 members of Congress to vote by proxy when the Consolidated Appropriations Act of 2023 was passed in December 2022.
According to Paxton, Pelosi's rule was against the Quorum Clause, which stipulates that in order for Congress to undertake business, the majority of the House must be present on the floor.
"'Quorum' is a quorum, period. There is no other way around it, according to Paxton. "You could never do it right if there wasn't a quorum. It was both passed and signed in violation of the law.
The Enrollment Rule, which prohibits challenges to bills that are "enrolled" in official House or Senate documents, is one barrier to Paxton's complaint. The "Enrollment Rule does not supersede a constitutional provision," according to Paxton.
According to Paxton's news statement, "our state will be affected by the results of their lawlessness and deceit. It is critical that Texas residents are not subjected to these severe harms, such the millions of cash used to support illegal immigration.
With Customs and Border Protection predicting a record 2.6 million migrant interactions at the southern border this fiscal year, the Lone Star State is on the front lines of the border crisis.
While the injunction's legal proceedings are still ongoing, Paxton tells Fox News Digital that it would be a "win" for Texas to be granted relief from the rising costs of illegal immigration, which he estimates to be in the billions.
"It would be a win if we are shielded from the cost and our portion of it doesn't have to be paid. That's undoubtedly a victory for the people of Texas, but it's still a defeat for the nation and a setback for my state, according to Paxton.
