Policies Approved: Undocumented Immigrant Officers Now Permitted to Carry Weapons, Says LAPD Review Committee

A committee that reviews policies for the Los Angeles Police Department has given its stamp of approval to new policies that would enable undocumented immigrant officers to carry weapons at all times.

Those who were able to work as a result of President Obama's executive order granting deferred action to children who entered the country illegally as youngsters were able to become police officers in California in 2022. With the Los Angeles Police Department (LAPD) expecting to graduate nine DACA participants in the spring of 2024—the first class to do so occurred earlier this year—the subject of whether or not DACA beneficiaries should be authorized to carry guns off duty is sure to spark heated discussion.

It is against the law for illegal immigrants to own weapons, both at the state and federal levels. On the other hand, DACA holders can legally carry weapons while on the job. Given that a police officer is essentially on duty at all times, the Los Angeles Board of Police Commissioners passed a policy guideline outlining how DACA holders can bring their guns off the job with unanimous approval.

The Los Angeles Board of Police Commissioners "unanimously approved" a policy framework that would legalize concealed carry for DACA beneficiaries, who are not citizens of the United States but are nonetheless able to work legally.

"We’ve worked closely with the Department of Justice at the state and federal level to express the fact that we desire to form a model policy that we think meets this moment and is the state of the law and provisions of immigration policy in the United States," Michael Moore, the Los Angeles Police Chief, said in an interview with Fox.

We will not let DACA beneficiaries to carry weapons off duty until the Los Angeles Police Department fully adopts a policy, not simply an outline. Colorado passed a comparable measure in April 2023, making it the second state to follow California's lead in allowing DACA beneficiaries to become armed police officers. Both states had previously sought and received federal clearance for this measure.
