In support of the Biden administration, the Supreme Court ruled that the Border Patrol may dismantle physical obstacles that the Lone Star State had placed in place. Representative Clay Higgins (R-LA) urged Texas to disregard this decision.

Following the U.S. Court of Appeals for the 5th Circuit's decision to prevent the federal government from removing wire that Texas had installed to prevent illegal immigrants from crossing the border, the court granted the Justice Department's request on January 2 to intervene in a dispute between the Biden administration and Texas. The administration should have the authority to take down any physical obstacles that the state of Texas has put up, according to the Supreme Court.

The contentious remark was a reaction to the Supreme Court's 5-4 decision on Monday.“Media: ‘Congressman Higgins, the Supreme Court just ruled in favor of the Biden Admin over the State of Texas, saying that the federal government can remove physical barriers at the border put in place by Texas. What are your thoughts?'” Higgins recalled being asked.
“Me: ‘My thoughts are that the feds are staging a civil war, and Texas should stand their ground,'” he wrote.
