Texas Court Overturns Biden Rule on Greenhouse Gas Emission Testing for Highway Cars

On March 28, a Texas court overturned a Biden administration regulation requiring states to test and report greenhouse gas emissions from national highway system cars.

Under President Biden's plan to cut carbon emissions in half by 2030, the DOT's Federal Highway Administration (FHWA) released the regulation in 2023.

State transportation agencies and metropolitan planning organizations (MPOs) have to measure and establish emission reduction objectives for their highway system emissions.

The proposal also compelled state DOTs and MPOs to report on their falling goal progress biennially. The regulation states that FHWA would evaluate the state's progress toward such benchmarks.

In December, Texas sued the DOT, claiming it violated the Administrative Procedure Act and lacked congressional authorization to impose the rule.

Judge James Hendrix of the U.S. District Court for the Northern District of Texas agreed that the Biden administration had no legal jurisdiction to enforce the greenhouse gas emissions performance criterion.
