Trump's Legal Team Appeals Ballot Exclusion Over Capitol Uprising Allegations

The former president has filed an appeal against the decision of an Illinois court to exclude him from the state's ballot due to his involvement in the Capitol uprising on January 6, 2021. 

On Wednesday night, Trump's legal team filed an appeal with the Appellate Court of Illinois, requesting the overturning of Judge Tracie Porter's decision. Following a verdict on Wednesday, Porter directed the state election board to strike the former president off the state's March 19 primary ballot. Porter suspended her ruling until Friday so that Trump's legal team could file an appeal.

The appeal was submitted on Wednesday night, and it requests that the state's Electoral Board judgment be upheld and Porter's decision "reversed and vacated" by the appeals court. Separately, in a Wednesday-dated plea, Trump's legal team asks Porter to keep the suspension in place beyond Friday until the Appellate Court issues a decision.

Prior to the state primary, Trump's attorneys said that having his name on the ballot would "reduce the great risk of voter confusion and logistical difficulties for election officials." Afterwards, on Thursday, Porter took the side of Trump's attorneys and said that the appeals court's decision would halt the implementation of her judgment, allowing him to stay on the ballot.

After verdicts in Colorado and Maine in recent months, Illinois became the third state to try to remove Trump off the ballot.

The Colorado Supreme Court declared in December that Trump was ineligible to run for the state's election due to the insurrectionist clause of the U.S. Constitution. The U.S. Supreme Court is now considering Trump's appeal of that ruling. The state supreme court determined that the former president's involvement in the Capitol assault on January 6, 2021, constituted his participation in an uprising. Following the state secretary of state's decision to disqualify him, a court in Maine said last month that Trump may remain on the state's ballot until the U.S. Supreme Court issues its verdict.

The national charity Free Speech For People, which has many ballot challenges in other states, including Michigan, Minnesota, Massachusetts, and Oregon, filed a challenge, and Porter's decision was in response.

The Illinois State Board of Elections had unanimously decided last month that Trump may continue to be on the state's primary ballot; however, Porter's judgment reversed that determination. Four Republicans and four Democrats make up the board, which said last month that it lacked the authority to comment on the issue.

Steven Cheung, a spokesman for the Trump campaign, denounced Porter's decision on Wednesday, branding her as a “activist Democrat judge.”

Today, an Illinois activist Democrat judge abruptly overturned the state board of elections and disregarded previous rulings from several other state and federal authorities. We will file an immediate appeal against this illegal verdict.
