Texas Judge Rejects Musk's Bid to Toss Defamation Suit Over Nazi Portrayal

A Texas judge has denied Elon Musk's request to dismiss a defamation lawsuit against him for allegedly portraying a Jewish student as a Nazi. Ben Brody, a 22-year-old college student, filed the lawsuit in October, alleging that Musk had magnified remarks on Twitter that incorrectly characterized him as a member of a right-wing extremist group.

In June 2023, Brody was accused of being involved in a brawl between mask-wearing individuals and members of the Proud Boys and the Rose City Nationalists. An unidentified user on the X platform shared a snapshot of Brody's face alongside a photograph of Brody. Musk responded with a response that was "Very odd" and "Remember when they called us conspiracy theorists for saying the feds were planting fake Nazis at rallies?".

Brody, the 22-year-old student, argued that the allegations made against him regarding his affiliation with far-right organizations are "utterly profane and blasphemous." However, Mark Bankston, the attorney for Brody, said that Musk's attempts to get the case dismissed entirely were unsuccessful. Bankston was also the legal representative for the families of the victims of the Sandy Hook shooting in their successful defamation lawsuit against Alex Jones.

Musk tried to have the lawsuit dismissed through a process known as "anti-SLAPP," which required clear and specific evidence for each component of Brody's claim.
