Robert F. Kennedy Jr.'s presidential campaign has put CNN on notice after Kennedy's failure to advance beyond the network's debate stage.

President Joe Biden and former President Donald Trump will participate in the debate next week, with Kennedy not present due to insufficient state ballots and not getting 15% of the vote in four valid polls. CNN will hold the debate on June 27 with Jake Tapper and Dana Bash moderating.

The Kennedy campaign statement stated that a candidate's name must appear on a sufficient number of state ballots to reach the 270 electoral vote threshold. The campaign claims that CNN's "presumptive nominee" clause is illegal and not in the Federal Election Commission's debate regulation. This implies that CNN and all employees involved in organizing, carrying out, and hosting the discussion could be prosecuted for breaking campaign financing rules, similar to Michael Cohen's case.

Given the evidence that the Biden campaign explicitly urged Kennedy to be kept out of the debates and that Trump was offered promises by CNN, CNN and its employees are on notice. The campaign plans to sue CNN for engaging in "un-American conduct."
